1. Acceptance of Terms
These Terms & Conditions (“Terms”) form a legally binding agreement between you and Donum LLC, Donum Capital, and the Donum Charitable Lending Fund (DCLF1) (collectively, “Donum,” “we,” “us,” or “our”). By accessing or using the Donum websites, including donumplan.com, any related subdomains, and any content, features, or services made available through them (collectively, the “Services”), you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Services.
2. About Donum
The Donum family of companies includes Donum LLC, the donor-facing insurance representative; Donum Capital, the investor-facing general partner; and the Donum Charitable Lending Fund (DCLF1). All entities operate in compliance with U.S. Treasury regulations and applicable tax laws. Donum does not violate the Donum Statement of Faith.
The Services describe our charitable-finance programs — Tax Defund, Tax Divest, and Tax Divert — for general informational purposes. Participation in any program is governed by separate engagement, subscription, or account documentation executed between you and the applicable Donum entity.
3. Eligibility
You may use the Services only if you are at least 18 years old, can form a binding contract with Donum, and are not prohibited from using the Services under the laws of the United States or any other applicable jurisdiction. The Services are intended for residents of the United States. We make no representation that the Services or any program are appropriate or available in other locations.
4. Use of the Services
You agree that you will not:
- Use the Services for any unlawful, fraudulent, or misleading purpose, or in violation of these Terms;
- Attempt to gain unauthorized access to any portion of the Services, our systems, or the accounts of other users;
- Interfere with or disrupt the integrity, security, or performance of the Services, including by introducing malware or launching denial-of-service attacks;
- Use any robot, spider, scraper, or other automated means to access the Services or to collect information from them without our prior written consent;
- Copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any portion of the Services; or
- Use the Services to transmit content that is defamatory, harassing, infringing, or otherwise objectionable.
We reserve the right, without notice and in our sole discretion, to limit or terminate access to the Services for any user who, in our judgment, violates these Terms or engages in conduct that we believe may harm Donum, our clients, or others.
5. No Financial, Tax, or Legal Advice
The Services are for informational purposes only. Nothing on the Services constitutes, or should be relied upon as, financial, investment, accounting, tax, or legal advice.
Hypothetical examples, sample client summaries, and illustrative figures shown on the Services are for educational purposes only. They are based on assumptions and do not reflect the actual results of any particular person. Actual outcomes will vary depending on, among other factors, your income, residency, applicable federal and state tax rates, and your individual facts and circumstances.

8. Intellectual Property
The Services and all content made available through them — including text, graphics, logos, images, video, audio, software, and the selection and arrangement thereof (collectively, the “Donum Content”) — are the property of Donum or its licensors and are protected by copyright, trademark, and other intellectual property laws. “Donum,” the Donum logo, and related marks and slogans are trademarks of Donum.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial informational purposes. No other rights are granted by implication or otherwise.
9. User Submissions
If you submit information, questions, feedback, or other content to us through the Services (for example, through our contact form), you grant Donum a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and distribute your submission in connection with the Services and our business, subject to our Privacy Policy. You represent that your submission does not infringe the rights of any third party and does not contain material that is unlawful, confidential to a third party, or otherwise restricted.

The Services may contain links to third-party websites, products, or services. Such links are provided for convenience only and do not imply endorsement. Donum does not control, and is not responsible for, the content, policies, or practices of any third party.

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

The Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by applicable law, Donum and its affiliates, officers, directors, employees, agents, and licensors disclaim all warranties, express or implied, with respect to the Services, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components, or that the content on the Services is accurate, complete, or current.
13. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Donum or its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our aggregate liability for all claims arising out of or relating to the Services will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above will apply to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Donum and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your access to or use of the Services, (b) your breach of these Terms, or (c) your violation of any law or the rights of any third party.
15. Governing Law & Dispute Resolution
These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the United States and the State of Delaware, without regard to its conflict-of-laws rules.
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding, individual arbitration administered by a recognized arbitration provider mutually agreed upon by the parties, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. You and Donum each agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
16. Termination
We may suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason, including your breach of these Terms. Upon termination, your right to use the Services will cease immediately. Sections intended by their nature to survive termination will survive, including Sections 5 through 15 and 18.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services.
18. Miscellaneous
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Donum regarding the Services and supersede all prior or contemporaneous understandings. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice. Headings are provided for convenience only and have no legal effect.
